Second Store
Second Store updates and information
The second retail site Owner input committee has continued to review a list of potential sites—this list started at 27 and has been narrowed to 10.
At this time, I don't have any news to report; we're still negotiating with the receiver appointed by the bank to oversee Metro Place, Phase II. I just wanted to let you know the status of the project. When there are any developments, I will be sure to announce them on our website, in the information station in the store and in our newsletter.
On June 19, Board President Renée Lauber, Ann Smith of Michael Best & Friedrich, LLP (our legal counsel), Jim Bower (Development Services Consultant), and I met with the Michael Polsky (who was appointed receiver of Metropolitan Place, Phase II) to discuss the offer that was made by the Co-op for MPII on May 6.
Metropolitan Place Phase II is one of three places currently under consideration for a second store site. One requirement of any new deal that we would agree to would be that Buckingham LLC (the developer and our landlord under the previous lease) would not be our landlord.
This morning we terminated our lease with the Metropolitan Place II site, after the unanimous vote by the Board of Directors. This was a difficult decision to reach, but the ongoing costs (which appear to be extremely difficult if not impossible to recoup) make continuing to pursue this site a financial risk to the health of the Co-op. Update on Downtown Store (2/28/08)
Buckingham has succeeded in its request to change judges in the receivership proceeding. The case has been assigned to Judge Niess, and the bank is trying to get on his calendar for a hearing. At this point, I do not know if that will occur within a week, or much later - that depends upon the judge's current calendar and commitments.

Downtown store project 02/26/08 update
Update on Downtown Store (2/5/08)
The bank that was funding the Metropolitan Place II project is recommending foreclosure on the project. The developer has 20 days to respond as of 1/31. We are still working with the developer in hopes of resolving the issue and opening a store at Metro Place. The Board's Finance Committee will meet on Tuesday (2/11/08) to discuss possible next steps.
